NextACT Survey Results 2009
ELI® recently conducted a survey of human resources and legal representatives from organizations across an array of industries to determine what behavioral issues and trends affect today's workplaces. We asked participants to respond to a series of questions identifying both successes and needs in their workplace culture. Survey participants identified which issues their organizations experienced more: issues that are illegal or issues that are legal but unprofessional and problematic. They also analyzed employees’ comfort levels about bringing forward their concerns to managers and identified what factors influence employees’ confidence in management. Finally, participants provided information about their organizations’ values and how well management communicates those values.

California's Mandatory Training Whitepaper
Most employers have become familiar with the California mandate that requires two hours of sexual harassment training every two years for the supervisors of organizations with fifty or more employees. Unfortunately, those in the business world often refer to such mandatory training as “check the box” training, relegating it to that which must be done but which will probably be ineffective at preventing and correcting sexually harassing behavior. Employers who want the sexual harassment training to be effective must look beyond fulfilling a requirement – simply checking a box – and insist on training that makes a difference in their workplace culture.

Laws of Change: The Rise of Values
Although most organizations have established values and are implementing sexual harassment training and other initiatives to comply with applicable laws, many have been unable to integrate their values into the workplace culture. Often, a compliance-driven approach has clouded the overarching cultural objectives the values are meant to address. With an array of subtler, not necessarily illegal behaviors increasingly causing harm in the workplace, the law cannot be relied upon as the sole driver of behavior change. Instead, the legal component should be viewed as one aspect of a broader initiative designed to align behaviors with the values and integrate them into the day-to-day culture.

The Mandatory Training Debate
As part of its commitment to end workplace sexual harassment, California has joined a number of states mandating sexual harassment prevention training for managers and supervisors. Much of the debate about such mandatory training requirements has focused on the tactical aspects – delivery methods, length of training, whether faster learners need additional content to ensure they participate in a full two hours of online training, which group of individuals needs to be trained, who can conduct the training, and similar concerns. While all of this is well intentioned, it likely misses the true objective of the regulations, which is to prevent, detect, and correct workplace harassment. Without changing behavior, the training – no matter how it’s delivered – will fall short of this goal.
